Terms of Service

1. Who this agreement is with

This is an agreement between you and ATTEND LLC, a Rhode Island limited liability company (“ATTEND,” “we,” “us”), governing your use of the ATTEND web and mobile applications (the “Service”) — regardless of whether you use the Service as ATTEND staff (Admin), an onsite contractor (Worker), or a client event manager (Client).

2. Accepting these terms

Every account, on every role, must accept the current version of these Terms and the Privacy Policy below before using the Service. If we make a material change, you will be asked to accept the updated version the next time you sign in — continued use after that point means you accept the change. If you do not agree, do not use the Service and contact your ATTEND administrator.

3. Accounts and roles

Access is provisioned by an ATTEND administrator and tied to one of four roles: Super Admin and Admin (ATTEND staff, or a client’s own staff scoped to their events), Worker (onsite contractor), and Client (an event organizer’s own login, scoped to their events only). You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us immediately if you suspect unauthorized access.

4. Workers: independent contractor relationship

Unless your account is separately marked as an internal employee of a client company, your relationship with ATTEND as a Worker is that of an independent contractor, not an employee, agent, or partner of ATTEND. You are responsible for your own taxes, including providing accurate taxpayer information (via the in-app W-9), and for any insurance or licensing your work requires. Nothing in these Terms creates an employment relationship, a guarantee of minimum work, or exclusivity in either direction.

Pay rates, per-diem, and reimbursement terms for a specific engagement are as stated on that project’s assignment and any signed engagement statement or master agreement — those documents control over any conflicting general statement here.

5. Clients

A Client login gives an event organizer’s staff visibility into their own event’s staffing status, hours sign-off, incident/handover log, and post-event report — never another organizer’s events, and never ATTEND’s internal pay rates or margins. Approving hours through the Service (“sign-off”) confirms the hours shown are accurate to the best of your knowledge as of that approval.

6. Acceptable use

Use the Service only for its intended purpose of coordinating event staffing, timekeeping, and related administration. Do not attempt to access another user’s data, another client’s events, or another worker’s pay information; do not upload unlawful, harassing, or infringing content; do not attempt to probe, scan, or interfere with the Service’s security.

7. Data you submit

You are responsible for the accuracy of information you enter — time and expense entries, invoices, W-9 details, project and contact information. Falsifying time, expenses, or tax information is grounds for immediate account termination and may have legal consequences.

8. Termination

We may suspend or terminate your access at any time, particularly for a violation of these Terms, non-payment, or the end of your engagement with ATTEND or a client. You may stop using the Service at any time by contacting your administrator. Sections that by their nature should survive termination (payment obligations already accrued, confidentiality, limitation of liability) do survive.

9. Disclaimers and limitation of liability

The Service is provided “as is.” ATTEND does not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, ATTEND’s total liability arising from your use of the Service is limited to the fees you paid ATTEND (if any) in the twelve months before the claim, and ATTEND is not liable for indirect, incidental, or consequential damages.

10. Governing law

These Terms are governed by the laws of the State of Rhode Island, without regard to its conflict-of-laws rules. Any dispute not resolved informally will be brought in the state or federal courts located in Rhode Island, and you consent to that jurisdiction and venue.

11. Contact

Questions about these Terms can be directed to your ATTEND administrator, or to ATTEND LLC directly at the contact information provided on attendstaff.com.

Privacy Policy

1. What this policy covers

This Privacy Policy explains what personal information the ATTEND Service collects, why, and how it is protected, for every role — Super Admin, Admin, Worker, and Client alike.

2. Information we collect

Account information: name, email address, password (stored as a salted hash, never in plain text), and role.

Worker payment & tax information: hourly and travel rates, home address, invoicing details, bank account/routing/wire/SWIFT numbers you provide for payment, and W-9 tax information. Your Social Security Number or Employer Identification Number is encrypted at rest (AES-256-GCM) and only the last four digits are ever shown back to you in the app; it is decrypted only to generate your official W-9 PDF for tax filing.

Time, location, and activity: clock-in/out times and the timezone you logged them in; the venue and home addresses used to estimate travel; and, only if you opt in, step count, active/sedentary minutes and calories burned from a paired smartwatch or phone during a timed shift. Turning that sharing off deletes what was already shared. We do not collect continuous or minute-by-minute location tracking.

Onsite check: if you allow location access in the mobile app, it checks your phone’s position when you open the app, to take you straight to a project whose venue you’re at during its contract dates. That check happens on your phone: the Service sends your phone the venue coordinates of your current projects, and your own position is never sent to ATTEND or stored. You can turn location access off in your phone’s settings, or choose a fixed start screen in the app.

Apple Health: if you allow it, the iPhone app reads calories burned, steps and body weight from Apple Health. It never writes to Apple Health. Calories are uploaded only as part of the opt-in shift sharing above, and the weight read from Apple Health stays on your phone. A body weight you type in yourself is stored with your account for your own calorie estimate and is never shown to admins. Health data is never sold or used for advertising.

Documents and images: expense receipts (including text extracted from them for your own record-keeping), signed contracts and agreements, uploaded logos, and event floorplans/reference documents.

Client and project information: event details, venue and contact information, staffing requests, and incident/handover log entries.

Device information: if you pair a smartwatch, its platform, model, and OS version, so we can support it; and, if you opt into browser push notifications, the subscription details needed to deliver them.

3. How we use this information

To operate the Service: scheduling and staffing, timekeeping, expense review, invoicing and payroll, contract generation, tax reporting (1099s), client billing, and the incident log and post-event reporting clients see. We do not sell personal information, and we do not use it for advertising.

4. Who can see what

Workers see their own time, pay, and documents only. Company-scoped Admins see only their assigned client companies’ projects and workers assigned to them — never another client’s data or another company’s pay rates. Client logins see only their own organization’s events, and never pay rates or internal margins. Super Admins and global Admins can see data across the platform as needed to operate the business.

5. Where data is stored and how it's protected

Data is stored on Cloudflare’s infrastructure (D1 database and R2 object storage). Passwords are hashed with bcrypt; taxpayer ID numbers are encrypted at rest; access to the Service requires authentication, and every role is scoped to only the data that role is meant to see, enforced on every request.

6. Retention

Financial and tax records (invoices, pay runs, W-9s, contracts) are retained as needed for legal, tax, and accounting purposes and are archived rather than deleted, even when “removed” from your normal view, so the business’s financial records stay accurate and auditable. You can ask us to delete other personal information (see below), subject to what we’re legally required to keep.

7. Your choices and rights

You can review and correct most of your own information directly in the app (account details, invoicing details, W-9). Shift-activity sharing is opt-in and can be turned off at any time. To request a copy of your data, a correction, or deletion of information we are not required to retain, contact your administrator or ATTEND directly.

8. Children's privacy

The Service is intended for working adults and is not directed at children.

9. Changes to this policy

If we make a material change to this Privacy Policy, we will ask you to accept the updated version the next time you sign in, the same way as a change to the Terms of Service above.

10. Contact

Questions about this Privacy Policy can be directed to your ATTEND administrator, or to ATTEND LLC directly at the contact information provided on attendstaff.com.
